Terms and Conditions
General
This is a legally binding contract between the property owners, Derek Boak & Fiona Quinn and the holidaymaker. The property owners are also referred to as "we" and "us".
The holidaymaker is the person who signs the booking form or, in the case of online booking, the person who makes the online payment. This person is responsible for ensuring all members of the holiday party accept and adhere to these terms and conditions. The holidaymaker is also referred to as "you".
The property referred to being Lamothe Haut, Lamothe Haut, Sainte-Colombe-de-Villeneuve, Lot-et-Garonne, 47300, France.
Bookings
A booking deposit is payable within 2 days of the provisional booking being taken. The booking is taken on a provisional basis until the deposit has been paid in full and funds cleared through the banking system (where appropriate). The booking then becomes confirmed. Until the booking is confirmed, it can be cancelled at any time without prior notice.
The balance of the rental charge, along with the breakage deposit, is payable not less than 8 weeks prior to the start of the holiday. Failure to pay the deposit or balance in full by the due dates will constitute a cancellation of the holiday by the holidaymaker. Please be sure to note the due dates of these payments as reminders are not routinely issued.
Bookings made less than 8 weeks prior to the arrival date must be paid in full at the time of booking.
Cancellation by the Holidaymaker
Cancellation of the booking by the holidaymaker should be made in writing to the owners at info@boutiquegitefrance.com.
If the holidaymaker is forced to cancel their holiday more than 8 weeks from the start of the holiday date, only the deposit paid shall be forfeited. If the holidaymaker cancels less than 8 weeks before the start of the holiday date, all monies paid will be forfeited – whether he is insured for this risk or not.
Cancellation by the Property Owners
The property owners will endeavour to make sure the stated property is available for the dates contracted. In the unlikely event the property becomes not available and the property owners have to cancel the booking, the holidaymaker shall be entitled to a full refund. The property owners shall only be liable to return the monies received. No compensation or consequential losses shall be paid.
Miscellaneous
Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.
The property owners reserve the right to enter the property, at a reasonable time, in the event of an emergency or remedial repair work being required. Under no circumstances may the holidaymaker touch or interfere with any pool equipment or materials or other similar equipment. The owners reserve the right to take any relevant action, including immediate termination of the tenancy, if any property including the swimming pool and its grounds are abused or misused. Damage to the lining of swimming pools as a result of the fault or abuse, either wilfully or negligently or otherwise, of the holidaymaker or guests will be fully charged to the holidaymaker up to the cost of replacing, such liner and any consequences thereof.
The property owners are entitled to ask the holidaymaker and their party to leave the property, without any refund if, in the property owners' opinion, the behaviour of the holidaymaker and/or his/her party is unacceptable.
The property owners reserve the right to refuse entry to anyone, who in the property owners' opinion is not suitable to or capable of taking charge of the property.
The parking of caravans (motorised or otherwise) or camping is not permitted on the property grounds without written permission of the owners.
The holidaymaker agrees not to act in any way, which would cause disturbances to those, resident in neighbouring properties.
Number of Guests
The maximum number of people entitled to stay at this property is 4 and furthermore, only those people named on the booking form are entitled to stay. If it is found that more people than agreed are using the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund. Sub letting or assignation of the let is prohibited.
Minimum Age of Guests
The minimum guest age is 12 years old. If the holidaymaker is accompanied by any child under this age limit, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund. Sub letting or assignation of the let is prohibited.
Pets
Pets are not allowed in the property. If it is found that a holiday maker brings a pet to the property, this will be considered a breach of contract and the holidaymaker and his/her party will be asked to leave immediately without any refund.
Nudity
Whilst we understand the desire for an all-over tan, we ask that swimming bottoms remain on at all times when outside.
Smoking
Smoking is not permitted inside the property or within the grounds.
Arrival and Departure Time
Every effort will be made to have the property available from 16:00 on the day of arrival. The property must be vacated by 10:00 on the day of departure. Late departure will result in an additional charge being made. Information about keys and how to collect them will be provided once full payment has been received.
Liability
The property owners take no responsibility for the personal possessions of the holidaymaker or the holidaymaker's party. Vehicles and possessions are left entirely at the risk of the holidaymaker.
Furthermore the owners shall not be liable to the holidaymaker:
i) For any temporary defect or stoppage in the supply of public service (Electricity, Water etc) to the property, in respect of any equipment, plant, machinery or appliance in the Property, garden or swimming pool.
ii) For any loss, damage or injury that is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the owners.
iii) For any loss, damage or inconvenience caused to or suffered by the holidaymaker if the Property shall be destroyed or substantially damaged before the start of the rental period and in such event, the owners shall within seven days of the notification to the holidaymaker, refund to the holidaymaker all sums previously paid in respect of the rental period.
Please note that the owners do not take any responsibility for any injuries whatsoever and however caused with regard to the use of the swimming pool or any other facilities. Children should, at all times be supervised by a responsible adult. The holidaymaker is deemed to be wholly and exclusively responsible for all guests whilst at the property and specifically when the pool is being used.
The holidaymaker is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings, public liability etc, since these are not covered by the owners insurance.
Under no circumstances shall the owners liability to the holidaymaker exceed the amount paid for the rental period.
Cleaning
We would like to think the holidaymaker and party would treat the property as they would their own home and at the end of the holiday the property is left in a clean and tidy condition. The property owners retain the right to make an additional charge for cleaning should the property not be left in a similar condition to the way it was found at the start of the holiday.
Breakages
The holidaymaker should make every effort to keep the property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. Any accidental damage or breakages should be reported to the property owners (or their representative) prior to departure. The property owners retain the right to make an additional charge for damage and breakages although it should be noted that minor breakages and reasonable wear and tear (in the opinion of the property owners) will not be charged for. Should the Breakage Deposit be insufficient to meet such costs or liability, any additional amounts are payable by the holidaymaker. The Breakage Deposit shall not limit the holiday makers liability to the owners.
Complaints
Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, we do recognise that from to time things do go wrong. In these circumstances, it is the responsibility of the holidaymaker to make any such problem known to the property owners (or their representative) immediately it becomes apparent, thereby giving the property owners the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained.
The property owners will make every endeavour to rectify any identified problems as soon as is reasonably possible.
Return of Breakage Deposit
Your breakage deposit, minus any deductions, will be returned to you via PayPal within 2 weeks of the departure.
Jurisdiction
This contract is entirely regulated by French law and will be considered to have been made in France. Any proceedings arising out of or in connection with this contract may be brought in any court of competent French jurisdiction.
